What is a prenuptial agreement?
A prenuptial agreement is a contract entered into between two people before they get married to each other. Prenuptial agreements are becoming increasingly more common with every marriage. Once only used by wealthy individuals to protect their fortune in case of a divorce, these contracts are now being used by many different types of couples. In fact, many people who are getting married want a prenuptial agreement just to protect their house or to avoid paying alimony.
We are experienced in representing either party in a prenuptial agreement. We will meet with you to discuss the options for what you should include in the prenuptial agreement in the event of divorce, separation, or death. We will draft the prenuptial agreement and explain to you the best way to present the contract to your fiancé and to negotiate with him or her.
If you have been presented with a prenuptial agreement, we will meet with you and help you understand what you have been asked to sign. We will negotiate the terms for you and help you keep your relationship in tact so you can move on to a happy marriage.
Getting married is stressful and exciting even without having to worry about a prenuptial agreement. It is better not to wait and to finalize your prenuptial agreement well in advance of the wedding.
What is a postnuptial agreement?
A postnuptial agreement accomplishes the same goals as a prenuptial agreement, except that it is executed after you are married rather than prior to marriage. The postnuptial agreement can add a second layer of protection by reaffirming the prenuptial agreement.
What are the advantages of a prenuptial or postnuptial agreement?
- Prenuptial and postnuptial agreements are used as premarital asset preservation tools to protect personal and family assets for your children and beneficiaries
- Prenuptial and postnuptial agreements add certainty in the event of a divorce
- Prenuptial and postnuptial agreements avoid expensive litigation
- Prenuptial and postnuptial agreements can be written with the addition of a will or trust document
Can a prenuptial agreement be overthrown in court?
Yes, a prenuptial agreement (and postnuptial agreement) can be overturned IF one can prove fraud or nondisclosure of finances by either party, or if the agreement is overreaching or unconscionable, or made under duress or misrepresentation.
